On 1 May 2009 the Chief Judge issued a new Court attire policy. The policy applies also to proceedings in Class 8 of the Court's jurisdiction.

From 7 April 2009, the Land and Environment Court will have jurisdiction to hear and dispose of proceedings under the Mining Act 1992 and the Petroleum (Onshore) Act 1991. The Court will be establishing a separate practice collection to assist parties, including self represented litigants, by providing a wide range of information about the Court’s new mining jurisdictions.

The judgment in Double Bay Marina Pty Ltd v Woollahra Municipal Council [2009] NSWLEC 1001 at [47]-[52] which proposed a planning principle, concerning discerning the public interest in development applications, has not been adopted by the Court and will not be published on the Court's website as a planning principle of the Court.
