Sheriff's forms and fees

Standard forms

The main forms used by the NSW Sheriff’s Office  are available from the Uniform Civil Procedure Rules (UCPR) website.

The table below gives the form numbers and examples of how the forms are used. You can download the relevant forms from the UCPR website.

Form Enr-EBR003 (PDF, 356.9 KB): Eviction Booking Request

Used to initiate enforcement action on the following:

  • Warrant for Possession (NCAT)
  • Writ of Possession

Form 46: Application: Time to Pay - Individuals

(also known as Notice of Motion to Pay by Instalments - Individual)

Used when you need more time to pay money owed; or you are seeking to pay a debt by instalments.

Form 47: Application: Time to Pay - Corporations

(also known as Notice of Motion to Pay by Instalments - Corporation)

Used when a corporation needs more time to pay money owed; or is seeking to pay a debt by instalments.
Form 75: Notice to Sheriff of Disputed Property Used when goods that are included on the Sheriff's list for seizure do not belong to the person who owes a debt.
Form 20: Notice of Motion Used if you are seeking to suspend enforcement actions by the Sheriff's Office.

Fees 

The following table shows the fees of the NSW Sheriff’s Office as at 1 August 2023.

Sheriff's fees are determined by the Civil Procedure Regulation 2017 and Criminal Procedure Regulation 2017.

Executing or attempting execution of a writ of delivery under Part 8 of the Civil Procedure Act 2005

$100 for each address at which, and each occasion on which, execution is effected or attempted

Item 5

Executing or attempting execution of a writ for the levy of property under Part 8 of the Civil Procedure Act 2005

Note: The 3% levy in Column 2 is not payable in relation to writs executed by the Marshal in Admiralty

$100 for each address at which, and each occasion on which, execution is effected or attempted, plus 3% of the proceeds of enforcement
